Structured Settlement Protection Act Matters
- In any case filed in accordance with the Structured Settlement Protection Act (KSA 40-461 et
seq.), the transferee shall, in addition to the requirements set forth in KSA 40-465, include
the following information in the application:
- In any case filed in accordance with the Structured Settlement
Protection Act (KSA 40-461 et seq.), the transferee shall also specifically identify
the payee as the defendant with his/her full name.
- In any case filed in accordance with the Structured Settlement Protection Act (KSA 40-461 et seq.),
the Court may require the appointment of a guardian ad litem where the structured payments
are controlled and sought to be sold by a third party acting in a representative capacity for the payee.
The purchasing entity/individual may be required to advance and/or pay for such services, prior to a final adjudication.
- The Court concludes that such disclosures are necessary and appropriate to ensure that the
proposed agreement is consistent with the best interests of the payee, having taken into
account the welfare and support of payee and his/her dependents
